Strictly speaking, it does both. I know because I am one of the humans. See

SpamCop used to have "deputies" who would review listings if an ISP 
complained, and they were very good about discussing how to avoid getting 
listed and removing obvious false positives. Not sure what the policy is 
now. The company was sold to IronPort some time ago.

But you are right, your ISP should be talking to them. It takes more than 
one report to get listed.
